Jaundice is extremely common in newborns.
Most cases are temporary and resolve without causing harm. But when bilirubin rises to dangerously high levels and is not recognized or treated appropriately, bilirubin can injure the developing brain.

During pregnancy, the placenta helps remove bilirubin. After birth, the newborn’s liver takes over that job.
Because newborn liver function is still developing and newborns naturally turn over large numbers of red blood cells, bilirubin commonly rises during the first several days of life.
The American Academy of Pediatrics states that more than 80% of newborn infants develop some degree of jaundice.
For most babies, this does not cause permanent harm.

Acute bilirubin encephalopathy describes neurological dysfunction occurring while bilirubin toxicity is actively affecting the brain.

Kernicterus
Kernicterus generally refers to the chronic, permanent neurological effects of bilirubin toxicity.
A baby can have severe hyperbilirubinemia without developing kernicterus.
That is one reason rapid recognition and treatment matter.
When Should a Newborn’s Bilirubin Be Checked?
The American Academy of Pediatrics significantly updated its hyperbilirubinemia guidance in 2022.
For newborns 35 weeks’ gestation or older, the AAP recommends that every baby have at least one objective bilirubin measurement before discharge.

The current AAP guideline does not use those old risk zones to determine routine post-discharge follow-up.

The closer the bilirubin is to the phototherapy threshold, the sooner follow-up testing may be needed.
The AAP still uses age- and gestational-age-specific graphs and thresholds for treatment decisions, so the word “nomogram” may still appear informally. But the old Bhutani risk-zone method should not be confused with the current follow-up framework.
Why the Baby’s Age in Hours Matters
A bilirubin value cannot be interpreted responsibly without knowing when it was measured.
For example, the meaning of a particular bilirubin concentration can be very different at:
- 18 hours
- 36 hours
- 72 hours
- Five days
The AAP treatment thresholds therefore depend on the infant’s postnatal age in hours, along with gestational age and neurotoxicity risk factors.

Some factors increase the chance that the baby’s bilirubin will rise.
Other factors increase the chance that a given bilirubin concentration will cause neurological toxicity.

- Serum albumin below 3.0 g/dL
- Isoimmune hemolytic disease

Can a Cephalohematoma Increase the Risk of Severe Jaundice?
Yes.
The AAP specifically lists scalp hematoma or significant bruising as a risk factor for developing significant hyperbilirubinemia.
A cephalohematoma contains blood beneath the periosteum of a skull bone.
As that blood breaks down, additional bilirubin can be produced.
A cephalohematoma does not mean a baby will develop severe jaundice, but it can be one factor supporting closer monitoring.

The existence of G6PD deficiency does not itself establish that any provider was negligent.
Feeding, Weight Loss, and Jaundice
Inadequate milk intake during the first days of life can contribute to significant hyperbilirubinemia.
The AAP uses the term “suboptimal intake hyperbilirubinemia” for this pathway.
Potentially important evidence can include:
- Breastfeeding frequency

- Total serum bilirubin

The major treatment approaches include phototherapy and, in severe cases, exchange transfusion.
Phototherapy
Phototherapy uses specific wavelengths of light to change bilirubin into forms the baby’s body can eliminate more easily.
The AAP’s treatment thresholds are based on:
- Gestational age
- Age in hours
- Presence or absence of neurotoxicity risk factors
Phototherapy should therefore not be started or withheld based on a single universal bilirubin number.
The correct threshold varies from baby to baby.
Does Sunlight Treat Newborn Jaundice?
Parents should not substitute sunlight for prescribed medical treatment.
Current medical resources do not recommend placing a newborn in direct sunlight as a treatment for significant jaundice.

What Is “Escalation of Care”?

When Is Exchange Transfusion Used?
An exchange transfusion removes portions of the baby’s blood and replaces them with compatible blood products to rapidly reduce bilirubin and address certain underlying blood-related problems.
The 2022 AAP guideline recommends urgent exchange transfusion when:
- The baby’s TSB is at or above the applicable exchange transfusion threshold, subject to ongoing reassessment while treatment is being prepared, or
- The infant shows signs of intermediate or advanced acute bilirubin encephalopathy
Exchange transfusion is a major neonatal procedure.
The fact that a baby ultimately required one does not by itself establish that earlier care was negligent.
Experts must review the entire bilirubin trajectory and clinical timeline.
When Severe Jaundice May Raise Questions About Medical Negligence

The AAP recommends objective bilirubin screening rather than relying solely on visual estimation.
Failure to Recognize a Bilirubin Near the Treatment Threshold
Under current AAP guidance, follow-up after discharge is closely connected to the difference between the baby’s bilirubin and the phototherapy threshold.
A legal and medical review may therefore examine:
- The actual bilirubin result
- Applicable treatment threshold
- Gestational age
- Neurotoxicity risk factors
- How soon repeat testing was needed

Inadequate Discharge or Follow-Up Planning

Exact timestamps can be very important.
Failure to Recognize Hemolysis or Other Risk Factors
When the bilirubin rises rapidly or other findings suggest hemolysis, experts may evaluate whether appropriate testing and treatment were considered.

- Reticulocyte count

Not every baby requires every test.

Kentucky Law and Kernicterus Birth Injury Claims
Kentucky’s General Medical Malpractice Deadline
Under the current version of KRS 413.140, malpractice actions against covered physicians, surgeons, dentists, and hospitals generally must be commenced within one year after the cause of action accrues.
For covered medical malpractice claims, the statute provides that the claim accrues when the injury is discovered or, through reasonable care, should have been discovered.
KRS 413.140 also contains a five-year outside provision measured from the alleged negligent act or omission.
Deadline issues can be complicated in a kernicterus case because the baby’s serious neurological injury may not be fully understood when jaundice first occurs.
The deadline should be analyzed based on the actual claim and defendants.
Does Kentucky Toll the Deadline for an Injured Newborn?
KRS 413.170 provides tolling protection for certain claims when the person entitled to bring the action was an infant—meaning a minor—when the claim accrued.
Because KRS 413.140 falls within the range of statutes identified by KRS 413.170, minority can materially affect an injured child’s own medical malpractice claim.
But it is too broad to say that every claim associated with kernicterus automatically remains open until the child becomes an adult.
Different rules may apply to:

Special Rules Can Apply to UK HealthCare and Other State Institutions

Did Kentucky Add a New Medical-Malpractice Pre-Suit Notice Requirement in 2026?
No new general medical-malpractice pre-suit notice requirement from 2026 Senate Bill 195 became part of the enacted law.
The bill as originally introduced contained proposals involving:
- Medical-malpractice prelitigation notice
- A written medical opinion
- Changes to KRS 411.167
- Changes to KRS 413.140
Those provisions were removed during the legislative process.
The enacted version of SB 195 concerned other civil-liability issues and did not enact those proposed medical-malpractice provisions.
For current cases, lawyers should rely on the actual statutes in effect rather than summaries of an earlier version of the 2026 bill.
Does Kentucky Require a Medical Review Panel?
No.
Kentucky once enacted a mandatory medical review panel process for many malpractice claims.
The Kentucky Supreme Court held that law unconstitutional in Commonwealth ex rel. Meier v. Claycomb.
Parents therefore do not have to go through the former medical review panel system before filing a covered claim.
That should not be confused with the separate certificate-of-merit requirement under KRS 411.167.
